(you don’t have to read all, just read last news about phone camera)We can take a photo anywhere regardless of law only except for national secret stuff like army things. But is it right to take a photo without her allowance? Because there is no exact and directly related law, court said he is innocence. It can be confused between rights of seeing and taking photos. But I don’t agree with the court’s decision because there should be a morality. If court couldn’t punish him, I think his face have to be known to public instead of punishment. What is your opinion about it?I’d like t discuss more about this problem.
I learns law is some diffrent way with moral. For example, we should follow according to a code of law in korea. Even it makes you thought really illegal thing, It could be not illegal – but it doesn’t means innocent just we can not punish them. this principle called “nulla poena[nullum crimen] sine lege” – the principle of legality (If you don’t know it would good that you look it up). Anyway i am sure there are some problem from there. Law can not be perfect to people because it just applicate with most similar thing and in this process judge might need to do interpretation.
I think everybody remember this. When cell phone started to have a ‘camera’ function,at the very first stage, button for taking picture did not make any sound. Whenever people who have a cell phone having camera function used to take picture anywhere. Many social problems happened. Naked celebirities’ photos were taken in public spa and posted on the internet. That’s violation of human rights. Seriously.
Finally cell phone companies were forced to make their new products according this policy. ‘all new camera phones sold in South Korea must make a loud beep sound when taking a photo.’ It did help reducing bad cased of infringement but still they can use ‘flash’ instead of making sound and hide bright light with their finger.
Regardless any law, policy and crackdown, people cheating and playing a trick are everywhere.
Undoubtedly, there are flaws to excute the laws, but your argument that victim’s face should be known to public is not fair. Since muderers are
protected their individaulalities by covering their faces with masks, people who take photographs of others without permpermissions should be protected. In my opinion, the law should be executed on their action but their human right must be protected.
I agree with writer’s opinion that there should be a law. However, because the nature of the problem it is hard to regulate. There are so many poeple out there who uses phone with camera or digital cameras. Government officials as well as we, ourselves can not know how many they are. What I’m trying to say is, even if there’s a law related to this problem, it will be hard to be worked.
